43-year-old Ruben Marin-Garibay was arrested and is being charged with serious crime after police believe that he was driving the pick-up truck that hit and killed Henry County Police Officer Elgin Daniel on Monday night.

According to Major Jason Bolton of the Henry County Police Department, Mr. Garibay has been charged with homicide, serious injury by motor vehicle, failure to maintain lane and hit-and-run.

Several tips led them to the whereabouts of Garibay’s home.

Georgia State Patrol and the Henry County Police Department executed a search warrant at Garibay’s home wherein they recovered a Ford If-350 truck.

According to Major Bolton, the damage seen in Mr. Garibay’s vehicle is consistent with the collision on Monday night that killed an officer.

The unfortunate incident happened when Officer Daniel was helping a load gas to a stranded vehicle at east of Commerce Drive at Highway 138 near Stockbridge.

The owner of the vehicle that had run out of gas was Gordon Jarrett. He had called roadside assistance company for help wherein Daniel responded first then followed by 58-year-old John Cook from Atlanta who showed up with a thankful of gas. The three vehicles were situated in the center lane of the highway.

According to Jarrett, both men were helping him and the next thing he knew, he saw one body fly up the air. The suspect took off, then appeared to have stopped and took off again.

Jarrett added that everything had happed very quickly.

The rainy condition on Monday and the slick road conditions may have been a factor in the incident but this should have been obvious to the motorists to take caution and slow down for the police car in the highway’s center lane, according to the police.

Bolton said that the officer had turned on the emergency lights and is very visible. A motorist could have seen the blue lights and could have avoided and would have known that they haad been involved in an accident after striking two individuals.

Daniel has been with the Henry County Police Department from two years. He was also a retired lieutenant from the DeKalb County Police Department where he had worked for 26 years.

Cook was brought to Atlanta Medival Center where he is recuperating with the non life threatening injuries ha had sustained.

Preliminary hearing of Garibay is set on Wednesday morning at 8:30 am.
