Two lawsuits were filed in recent days in order to seek damages caused by fatal traffic accidents on Ind. 67.
The estate of Misty Conaster accuses Muncie resident David M. Wallace “carelessly and negligently operating his vehicle” last Feb 8 in a wrongful death suit. The collision occurred at eh stat highway’s intersection with Old Granville Road.
Conaster 34 also from Muncie was pronounced dead on the scene.
According to reports from Delaware County sheriff’s deputies Walace’s vehicle crossed the center line and collided with a car driven by Conaster’s sister Heather. A van hit those two vehicles.
The lawsuit was filed by Conaster’s mother Deborah. She says that Misty Conaster’s survivors have experienced suffering and the loss of her services, support, society, companionship and affection stemming from her death.
Meanwhile another lawsuit was filed last week in Circuit Court 4. It targets the estate of Ashley M. Melton the 21 year-old woman who was killed in a May 2011 accident at Ind. 67 and Royerton Road.
Deputies report that Melton was driving eastbound on Royerton Road when she ran a stop sign and crashed into a southbound SUV driven by 23 year-old Jenna Barker — now Jenna Barker Sanchez.
Sanchez seeks compensation from Melton’s estate for for “personal injuries, pain and suffering and mental anguish” caused by the accident.
Two passengers in Melton’s vehicle and Sanchez were injured during the early morning accident.
According to the suit, Melton was allegedly driving under the influence of alcohol stating that her behavior was “so outrageous” that “the public interest will be served by the deterrent effect of punitive damages.”
It also asks that the jury determine what those damages should be.
