Hackensack N.J. – A female pedestrian standing on a northern New Jersey sidewalk was struck by a driver whom authorities said was driving drunk. As a DUI, the operator will now be facing stiffer charges following the death of the woman.

Bergen County prosecutors stated that Victor Kwak, age 22, resident of Rutherford, will be filed homicide by car charges. Formerly, he was charged with aggravated assault by auto and DUI after the accident that happened at about 7:40 o’clock in the afternoon of Thursday in East Rutherford.

According to authorities, say Kwak lost control of his car and hit a curb, then veered towards a sidewalk and hit Sandra Munoz-Molina, age 28 and resident of Carlstadt. She was delivered to a hospital, where she succumbed from her injuries on Saturday.

Kwak was confined jailed on cash bail amounting to $75,000 cash bail. Authorities do not know if he had hired a lawyer.

A resident from Rutherford who was involved in a DUI collision that sent a woman from Carlstadt to the hospital with serious head injuries was arrested by the police from the Borough.

Last night, a pedestrian was hit on the sidewalk following a car that leapt on the curb in East Rutherford.

Prosecutor John L. Molinelli of Bergen County said that the suspect, a 22-year-old resident in Rutherford, Victor Kwak was charged for aggravated auto assault while driving within 1,000 feet distance from a school; crime of the 2nd degree crime, as well as driving while intoxicated and driving recklessly.

Both the East Rutherford Police Department and the Prosecutor’s Office Fatal Accident Investigation Unit stated that they were able to determine that Kwak was going eastward along Railroad Ave. towards the corner of Everett Place. For unknown reasons, he lost control of his vehicle, hit the curb along the south side of the road then went back across north and drove away from the road into the sidewalk of the north side.

His Lexus in the process struck and knocked down a tree, a street light and a wooden utility pole. At this point, Kwak hit pedestrian identified as Sandra Munoz-Molina, age 28 and resident of Carlstadt who was standing on the sidewalk

Munoz-Molina sustained critical head injury and rushed to the University Medical Center of Hackensack where she was listed in life-threatening condition.

Officers observed that Kwak was driving while intoxicated. However, his blood sample was taken to be submitted for toxicological examination.

In lieu of a $75,000 bail, Kwak was imprisoned at the Bergen County Jail Annex. Judge George Savino of the East Rutherford Municipal Court set a bail of $75,000 with no 10 percent cash option. Kwak will have his first day in the East Rutherford Municipal Court on September 4 at 1:00 o’clock in the afternoon.
